Smart1 Terms and Conditions

  1. All Instructors are self-employed franchisees of Smart1 driving School.
  2. It is hereby expressly agreed that the contract for tuition is made solely between the Instructor, as principal, and you, the Pupil.
  3. If you or your instructor wishes to cancel a lesson, a minimum of 48 hours prior notice should be given.
    Please note that all cancellations must be communicated between the Pupil and the Instructor or vice versa. The School retains the right to charge a full tuition fee if the above notice is not given.
    Smart1 driving school is unable to pass on cancellation information.
  4. Payment for tuition should be made in advance by cheque either direct to Smart1 (made payable to: A. Madlani) or to the Instructor, but in either case must be made payable to Smart1 (made payable to: A. Madlani). Alternatively the Pupil may pay the Instructor in cash or by cheque (made payable to A. Madlani) at the commencement of each lesson.
    However, you must obtain a receipt as Smart1 cannot accept any responsibility for any payments of cash made, or cheques made payable, to the Instructor.
  5. When making bookings, supplying any information or documentation to the Pupil and processing any payments, Smart1 driving school may act as agents of the Instructor and accordingly, the Pupil acknowledges that neither company nor A. Madlani can have any liability to the Pupil in respect of any matter which is subject to the contract between the Instructor and the Pupil.
  6. All matters relating to the timing, location and duration of individual lessons shall be subject to agreement between the Instructor and Pupil.
  7. Appointments:
    a. While every care will be taken to ensure Pupils receive training at the requested time, all bookings are made on the understanding that the School is not responsible for the postponement of training due to traffic conditions, adverse weather conditions, mechanical breakdown of equipment or any other cause outside of our control.
    b. If in the view of the Instructor, the pupil is unfit to carry out the lesson safely, due to self-induced circumstances (e.g. Alcohol or Drugs) a cancellation charge will apply.
  8. Coursework materials:
    All question papers, handouts, books, C.D. ROMs and relevant materials remain the property of Smart1 Driving School. (If not returned on request a fee will be charged).
  9. The driving test:
    The school reserves the right to withhold the training vehicle, if in the Instructors opinion, the pupil does not reach the required standard. The school cannot be held responsible for Test Appointments being postponed or cancelled by the Driving Standards Agency. Furthermore we are not responsible for any failure of light bulbs etc during the Practical test. All bulbs/lights etc will be checked at the test centre prior to the test, with the candidate. A fee of £ 4.50 will be charged if we book or alter your driving test on your behalf!
  10. Smart1 Driving School accepts no liability for personal property that is left in any training vehicle.
